NOTICE IS HEREBY GIVEN that a public hearing (#02-21) will be held before the Zoning Board of Appeals of the Town of Pomfret on the 4th day of May, 2021 at the Town Hall, 9 Day Street, Fredonia, New York at 6:30 P.M.  to consider the appeal of:

For property located at 9620 Farel Rd., Fredonia, NY 14063
                                            (address of property, city, and state)

The property is described as a portion of parcel identified on the Tax Map as Section 129.00, Block 4, and Lot 34.  The portion is that tract or parcel of land situated in the Town of Pomfret, County of Chautauqua and State of New York, being part of Lot 48 in Township 5 and Range 12 of the Holland Land Company’s survey, and more particularly described as follows:
Beginning in the southeasterly line of West Main Rd (US Route 20) as now laid out and occupied (66 feet wide) at the intersection thereof with the centerline of Farel Road (49.5 feet wide) as now laid out and occupied, thence northeasterly along said southeasterly line of West Main Road a distance of 265 feet to an existing iron pin; thence southerly at an interior angle of 77 degrees 12 minutes a distance of 350 feet to an existing iron pin; thence southwesterly at an interior angle of 172 degrees 10 minutes a distance of 101.4 feet through lands of the first party to an iron pin; thence northwesterly at an interior angle of 93 degrees 41 minutes a distance of 283.5 feet through lands of the first party to a point in said centerline of Farel Road, and passing through an iron pin located 25.3 feet southeasterly along the last described course from said centerline of Farel Road; thence northeasterly along said centerline of Farel Road a distance of 373 feet to the point or place of beginning, and containing 2.6 acres of land more or less.  Subject to rights of others in Farel Road.  NOTE: this description is included because an SBL has not yet been assigned to this newly created parcel, granted through approval of a minor subdivision of land by the Town of Pomfret Planning Board on March 1, 2021
The application is based on the denial of a building permit to construct a 100 ft x 60 ft pole barn for the purpose of creating a Pet Day Care, Pet Boarding and Pet Training business in an AR2 zone; thereby requiring approval of a Special Use Permit under Section 300-11 C, Large Lot Residential (R2) District of the Town of Pomfret Zoning Code adopted into Law on August 2014 and Local Law #1 of 2021.
                                  
The application for this Special Use Permit is open to inspection at the office of the Town of Pomfret Code Enforcement Officer, 9 Day Street, Fredonia, New York.

PLEASE TAKE FURTHER NOTICE that the environmental significance of the proposed request will be reviewed by said Board incident to said hearing. Said Board of Appeals will consider the application for a:
Special Use Permit to construct a 100 ft x 60 ft pole barn for the purpose of creating a Pet Day Care, Pet Boarding, Pet Training facility at 9620 Farel Rd  (SBL: 130.00-3-1)
     (area variance/use variance/special use permit)
 and the interpretation of the Zoning Law as it applies to the request of:
