NOTICE IS HEREBY GIVEN that a Public Hearing (#05-23) will be held by the Pomfret Zoning Board of Appeals on the April 4, 2023, at the Pomfret Town Hall, 9 Day Street, Fredonia, N.Y. 14063 at 7:00 P.M. to consider the appeal of:
Andy’s VBB Market, LLC, whose property is located at 5310 Route 5 Dunkirk, N.Y. 14048. For a: Special Use Permit__
This property is described on the tax map as SBL: 111.08-3-10. The proposed action is to have a temporary/seasonal food cart on the premises. It fails to meet the Town of Pomfret regulation Section 300-15 B “Use by Right.” A Food stand is not a “Use by Right” under the Town of Pomfret Zoning Code adopted in July 2022.
This application for a Special Use Permit is open to inspection at the office of the Town of Pomfret Code Enforcement Officer, 9 Day Street, Fredonia, N.Y. 14063.
PLEASE TAKE FURTHER NOTICE that the environmental significance of the proposed request will be reviewed by the Board at said hearing. The Zoning Board of Appeals will consider the application for an:
Special Use Permit for the temporary/ seasonal food cart on the premises located at
5310 Route 5 Dunkirk, N.Y. 14048 SBL: 111.08-3-10.
And the interpretation of the Zoning Law as it applies to the request of:
Andy’s VBB Market, LLC 5310 Route 5 Dunkirk, N.Y. 14048.
